Terms of Service

Please read all of the information below fully before requesting a commission or submitting an idea. This TOS changes infrequently, however, small details may have changed if you've worked with me in the past.

These terms may be updated without notice at any time. By commissioning, requesting, or otherwise agreeing to your character(s) being in art from me, you accept these terms as posted at the time of the agreement.

Content

I'll draw just about any kinks; I'm fine with a lot of stuff many artists tend to avoid, so if what you want isn't in the ranges listed below, go ahead and ask. If you want something within these ranges, please don't ask or try to figure out right where "the line" is to try and ride it. These aren't up for debate or negotiation, but if you want to know more detailed "why not?" about anything below, feel free to check my FAQ (once it exists >_> ).

Will not draw:

  • Secret / Private Commissions 

  • Surprise / Gift Art  — I will not use any individual's Original Characters or fursonas without their permission in advance or their presence in-stream at the time the image is being drawn.

  • Poop / Fart / Filth / Stink / Vomit / Diapers  — Watersports is fine. Musk is not the same as Stink. Cum from the mouth is not Vomit.

  • Females / Feminized / Cross-dressing males  — I'm not good at it. I'm not interested in doing it.

  • Non-binary genders  — I don't want to get it wrong and/or insult, offend, or misrepresent somebody.

  • HIV-positive / "poz" characters  — It's another minefield that I prefer to just avoid.

Legal Age

You must be over 18 to commission me, even if the work you wish to commission is not adult in nature.

Refusal

I reserve the right to decline a commission, request, or third party inclusion of anyone, at any time, for any reason.

My Rights

I retain all rights to the artwork I create and my characters. The following list is provided as an example only and not meant to demonstrate any limitation of rights. The following list is non-exhaustive:

  • to post and share the artwork wherever I wish

  • to use cropped portions of the artwork in other works such as banners or advertisements

  • to include the artwork in portfolio collections, prints, or art books

  • to include in other commercial use, such as digital or other physical merch

  • to do additional work on a commission if I wish

  • to ink a sketch, color, shade, or have someone else color the image

Your Rights

As a commissioner, you are granted the following rights:

  • all rights to your characters

  • to post and share the unaltered artwork wherever you wish

  • to use cropped portions of the artwork as an icon or banner, etc.

  • to color any uncolored linework yourself

 

Rights not granted:

 

  • You may not use the artwork for any commercial or third-party purpose. Please contact me separately for commercial work that will be used in a commercial context, such work may be performed under a formal contract with my commercial rates.

  • You may not have another artist color any uncolored linework, without first contacting me for authorization before any work has been done, unless the colorist is one of the few who have standing permission from me - ask me directly for that current list if interested. 

  • You may not make alterations yourself or have another artist make alterations that are not explicitly outlined above without first contacting me for authorization before any work has been done.

Caveats

  • If I or another artist of my choosing colors a commission that was only for black and white line art, then I will do my best to either ask for references or use the references given during the initial commission process to ensure accuracy. However, if a commission receives work beyond the level that was actually paid for (free additional upgrade), corrections will only be considered for particularly egregious inaccuracies. For example:

    • "My fur is blue, not yellow" — Acceptable

    • "My fur is supposed to be Pantone 214522" — Unacceptable

  • I don't do "secret" or "private" commissions where I am restricted in how or where I post/share what I've drawn. Any art where I would waive my rights of distribution and re-use would fall under my commercial rates which are, at a minimum, at least 5 times what the commissions would normally cost before. If you want me to disappear art I have done previously, there will be such a charge to do so, and the understanding that I cannot do anything about what already exists in the wild.

  • In the event of any interpersonal drama or falling-out with someone you were previously included in artwork with, or with me, I am under no obligation to alter, remove, take down, delete, or otherwise eliminate from any of my galleries or archives said artwork.

  • If you do not notice an error with your commission until after the completed artwork is delivered and approved, it is entirely at my discretion whether or not to go back and make corrections. The more recent the commission was and the more significant the error, the more likely I will make the correction. If a drawing was from a live stream session and you left or agreed to a slot where your presence was not required, then only the most significant of errors will be considered for correction.

  • Your character's presence in an image does not grant you any rights to the artwork beyond those outlined in "Your Rights" above, nor does it grant me any rights to use your character in any additional artwork without your consent. The rights to my characters and the image are mine, even if your character is in it, but the rights to your character are still yours and are not infringed by my continued exercise of my rights to the image.

Payment

I accept Square for payment. Other methods may be requested, but I may not be able to accommodate. Once I've accepted your commission, I will send you instructions for payment. I will not begin work until I've been paid in full. Do not send payment before I instruct you to do so. Any Payment sent to someone who hasn't agreed to do work for you isn't a commission, it's a donation. Make sure you have a formal agreement before you send anyone money.

Refunds

You may request a refund at any time before the work is completed, for any reason. If any work has been done on your commission, or if a delivery time was agreed upon and that time has not been reached, a base minimum of 25% will be kept for time spent in initial correspondence to arrange, organize, or schedule the commission, with an additional percentage retained based on the amount of work done. A full refund will only be delivered if an agreed-upon deadline has passed and/or no work has been done on your commission. Extenuating circumstances may be considered at my discretion. If funds are not available for an immediate refund at the time of the request (as is going to almost always be the case - I'm not sitting on fat stacks of furry cock money as may be assumed), you will be placed in a refund queue and paid as soon as the funds become available. No refund request will be considered after the work is completed.

Commission Process

I currently only take commissions through live stream sessions.

When I am streaming, I will announce it via FA submission, Twitter post, and notifications in my various messenger channels. The nature of the stream may be general audience work, personal work, or commission work. Commission work may have a set theme, or may be anything goes (within the constraints listed above). If I am taking commissions in that session, I will let the audience know, with the current criteria and pricing displayed. I use Picarto's built in raffle function to allow interested members of the audience to self-add to the raffle, which determines who gets the available slot. The winner is contacted with payment instructions, necessary references and details are given, and once payment is received, I begin immediately, with the commissioner watching live to give corrections or approval as needed throughout the process. In most circumstances, the completed commission is delivered that same day. If not, I will finish it in the next stream session.

While I understand many people dislike the raffle method of determining who gets available commission slots, or the requirement to be present for the stream, this method is what works for me. It is more efficient by not wasting my time or yours on email tag back and forth, and greatly eliminates the possibility of overdue or slipped-through-the-cracks commissions piling up. If I open for more traditional methods of commission, it will be announced on my various pages and platforms.
